First, what is the relationship between law and ethics? Although the principle of the relationship between these two important social areas seems clear, the quality of the relationship between the two is not clear. The relationship between ethics and law has long been a point of contention between moral philosophers and jurists. The reason for this difference is the difference between the different schools of law and ethics. In the Islamic view, the origin of both the field of ethics and law goes back to the will of the shari'a, and therefore the moral school of Islam will find a different relationship with law than other moral schools. The second question is how ethics as a different and at the same time law-related field can influence the legislative process? Can the legislature enforce the rule of law on moral judgments that naturally lack legal guarantees? Referring to the works of jurists in the field of authority of the Islamic ruler, it seems that if we are based on the theory of expediency of Imam (ra), the legislator can establish any expediency approved by experts as law, so moral rules if the interest of society requires. They will have the power to become law.}, keywords = {The relationship between ethics and law,customary ethics,Islamic ethics,government ruling,expediency theory}, title_fa = {کارکرد قواعد اخلاقی در نظریه حقوقی اسلام}, abstract_fa = {مقاله پیش رو در پی پاسخ به دو سوال اساسی است. اول اینکه رابطه میان حقوق و اخلاق چگونه است؟ هر چند اصل وجود رابطه میان این دو حوزه مهم اجتماعی روشن به نظر می رسد اما کیفیت نسبت این دو با یکدیگر واضح نیست. نسبت میان اخلاق و حقوق از دیرباز محل مناقشه فلاسفه اخلاق و حقوقدانان بوده است. دلیل این اختلاف، تفاوت در میان مکاتب فکری مختلف حقوقی و اخلاقی است. در دیدگاه اسلامی منشاء هر دو حوزه اخلاق و حقوق به خواست شارع بر می گردد و به همین جهت مکتب اخلاقی اسلام رابطه ای متفاوت از سایر مکاتب اخلاقی با حقوق پیدا خواهد کرد. سوال دوم این است که اخلاق به عنوان حوزه ای متفاوت و در عین حال مرتبط با حقوق چگونه می تواند در روند قانون گذاری تاثیر گذار باشد؟ آیا قانونگذار می تواند احکام اخلاقی را که طبعاً فاقد ضمانت اجرای حقوقی اند از پشتبانی قهری حاکمیت برخوردار سازد؟ با مراجعه به آثار فقها در حوزه اختیارات حاکم اسلامی، به نظر می رسد اگر تئوری مصلحت امام (ره) را مبنا بگیریم، قانونگذار می تواند هر مصلحت مورد تایید کارشناسان را به عنوان قانون وضع کند بنابر این احکام اخلاقی هم اگر مصلحت جامعه اقتضا کند توان تبدیل به قانون را خواهند داشت.}, keywords_fa = {رابطه اخلاق و حقوق,اخلاق عرفی,اخلاق اسلامی,حکم حکومتی,تئوری مصلحت}, url = {https://ethics.isramags.ir/article_143482.html}, eprint = {https://ethics.isramags.ir/article_143482_1938b8b9e1031a20e066a16e61584e67.pdf} }
